These Terms of Service ("Terms") govern your use of clearrisetechnologies.com (the "Site") operated by ClearRise Technologies (an S corporation based at 5635 North Scottsdale Road, Suite 170, Scottsdale, Arizona 85250) ("ClearRise," "we," "us"). Paid services are provided under a separate written agreement or order form, which controls if it conflicts with these Terms.
Use of the Site
You may use the Site for lawful purposes to learn about our services and contact us. You agree not to misuse the Site, including by attempting to disrupt it, submitting false information, or sending spam through our forms.
Information on the Site
Service descriptions, scope, and pricing on the Site are provided for general information and may change. Pilot volumes are scoped targets that depend on the availability of suitable, verifiable prospects and on working account access. The final scope, price, and terms of any engagement are set in your written agreement.
No guarantee of results
ClearRise does not guarantee leads, meetings, revenue, close rates, or any particular business outcome from our services.
Client responsibilities
Our outreach service creates unsent drafts; clients choose whether to send them. Clients are responsible for the content of messages they send and for complying with applicable laws, including CAN-SPAM and any other email, privacy, or marketing laws that apply to them.
AI Photo Manager
The AI Photo Manager automatically sorts photo copies, selects before-and-after pairs, recommends images, and generates captions and post drafts ("AI Outputs"). By using it, you acknowledge and agree that:
- AI Outputs are generated automatically from the photos you provide. They depend on the quality, consistency, and content of those photos, may occasionally be inaccurate or unsuitable, and are not guaranteed to be error-free.
- Reviewing AI Outputs is optional for using the service, but you are solely responsible for deciding what to publish, and for any content you publish or share, including its accuracy and any claims it makes about your work.
- You represent that you own or have the necessary rights and permissions to the photos you provide, including any that show people, private property, vehicles, license plates, or addresses, and to their use in marketing.
- ClearRise does not publish content on your behalf unless separately agreed in writing, and does not guarantee any marketing, engagement, lead, or sales results.
- To the fullest extent permitted by law, ClearRise is not liable for losses arising from AI Outputs you choose to publish or from photos you provide without proper rights.
You agree to indemnify and hold ClearRise harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from content you publish or send, from photos or other materials you provide without the necessary rights, or from your violation of these Terms or applicable law.
Third-party services
Our services may rely on third-party software such as email, spreadsheet, automation, and AI platforms. Those services are governed by their own terms and may carry separate fees. We aren't responsible for third-party services' availability or changes.
Intellectual property
The Site's content, design, and branding belong to ClearRise or its licensors. Product names mentioned are trademarks of their respective owners.
Disclaimers and limitation of liability
The Site is provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the extent permitted by law, ClearRise is not liable for indirect, incidental, or consequential damages arising from use of the Site. To the extent permitted by law, ClearRise's total liability for any claim relating to the Site or our services is limited to the fees you paid ClearRise in the three months before the event giving rise to the claim.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules.
Changes
We may update these Terms. Continued use of the Site after changes means you accept the updated Terms.
